Another Hoofer death

JUNE 21 UPDATE: Here's another article on the incident. It begins, "The tragic death of a skilled windsurfer last month in a collision with a rescue boat on Lake Mendota turned a spotlight on the University of Wisconsin Lifesaving Station. The rescues performed by the station’s lifesaving crews, on the other hand, typically go unnoticed." Is the Cap Times suggesting that death by motorboat doesn't warrant so much attention or that it's a fair trade-off given all the "rescues" they perform..? In either case, we emphasize that there are one or two scenarios where it may not have been entirely the rescue boat's fault.

JUNE 14 UPDATE: More info here. The DNR and UW are refusing to release investigatory data and video and have refused to allow examination of the boat. Incredibly, the boat has apparently been put back into service already, presumably so active use will wash off whatever evidence remains. Almost sounds like corrupt public officials trying to protect themselves from liability.

JUNE 13 UPDATE: More details are trickling in about Yu Chen's death. Apparently he was run over by the "rescue" boat from behind, which seems to suggest that the motorboat crew were indeed at fault in this tragedy. Chen's family has retained an attorney to sue the crap out of the UW. WARNING—the above link gives some fairly graphic details.

JUNE 5—We hoped to have more details on the investigation by now, but here are the basics.

Last Wednesday, Yu Chen, a popular Hoofer sailor and former instructor, and a good friend, was killed by the Hoofer/UW lifesaving boat. That would be the 31 foot twin-screw "rescue" boat which weighs in at about 8,700 lbs. Yu together with his board probably weighed about 180.

The clowns at the Badger Herald worded it as follows: "a 43 year old man was killed after colliding with" the UW lifesaving boat. That makes it sound like Yu ran into the motorboat! What it should say is: "after being hit by the UW lifesaving boat". Harvey knows very well that sailboards have right-of-way over motorboats. (And now the Herald staff know too.)

The accident occurred around 5:45 PM. How is that possible? Evidently something was impairing the rescue staff's ability to navigate. Sunset is 8:32 PM now, so the sun couldn't have been in their eyes. Maybe Yu was in the water at the time and thus not as visible, but that's no excuse either. There simply is no excuse.

"UW lifesaving" has become "UW Lifetaking".

  1. Alright, I ordinarily don't waste my time posting comments here, but this time it's worth the trouble. Couple of things I'd like to point out: First of all, for a blog that claims to be one of the last bastions of "Madison liberalism," your use of the word "retarded" points to the contrary. Secondly, semantics out of the way, the miserable bastards who run this blog don't seem to understand what happened here, and are as usual jumping to the inflammatory and nonsensical conclusions favored by those who have nothing better to do with their time than spread slander. Yu Chen's death was a tragic accident, but it was just that, and accident. Hoofers could not exist without the work of UW Lifesaving, it's as simple as that, and opting to throw them under the bus after one terrible accident in the decades they have ben serving Lake Mendota is nothing short of disgraceful. Accusing them of drinking on the job or being "on their knees" is slanderous (and again, for a blog that seems to love pointing out imagined slander and libel, that reeks of hypocrisy). There are so many people grieving at this point, Yu's friends, family, members of the club, lifesaving, EVERYONE is devastated at his loss. Those who write things like this do nothing to help those grieving, they affect no change, and incite anger where there is no need for any to exist. Have you given any though to how terrible the people on the lifesaving boat must feel? Those individuals will ask themselves over and over for the rest of their lives what went wrong and how they could have prevented it. Yu's death is undoubtedly a tragedy, but it was without question an accident. If you don't believe me, wait until the Sheriff's report comes out, which will undoubtedly confirm the accidental nature of his death. If those who run this blog wanted to do something productive and change the club for the better (as they pretend to attempt to do), perhaps they'd say something to remember and honor Yu, as the actual Club has already done, rather than immediately jump on UW Lifesaving as the people to hate. Beyond that, I hope those who moderate this cowardly blog fuck off and find something better to do with their lives than post nonsense about a club that they have no stake in and pretend that anyone gives a damn about what they say.

  2. Amen to the above post. UW Lifesaving and the staff take their work seriously. I agree that the wording on initial press releases made it seem like the deceased ran into the boat. Is that what happened? Only the official accident report can tell.

    I feel very bad for the staff at UW Lifesaving. This is very different than what happened the year before last when a passenger on a Hoofer boat lost his life. Ease-up on the professionals who save Hoofers and other Madison boaters all the time. They are not the Hoofer Instructors that you so vehemently smear.

  3. I've softened the wording a bit out of respect for Yu. Different admins use different tones of voice, and sometimes things are worded more bluntly than some people might like, but there's nothing slanderous here. The rescue boat drivers are almost certainly at fault. All the investigation will show is what they did wrong.

    Consider: A sailboat/sailboarder shouldn't be able to run into the rescue boat even if he wants to (unless the rescue boat is standing still). If I'm boarding in a 20 kn east wind and I come shooting out from the mooring field, any motorboat under power that collides with me is 100% at fault. If I suddenly tack or jibe and collide with a motorboat, the motorboat driver is 100% at fault. If I'm in the water, with or without a board, I have right-of-way over all boats.

    Of course it was an accident, but accidents still have causes, usually careless behavior. There are a few scenarios where it might not have been entirely the rescue staff's fault.

    Btw, we all have a stake in a better club, one where club leaders don't slander people or otherwise mistreat them.

  4. It is time for David Elsmo to go. Ever since he took he club over, we have had 2 deaths now. I don't know the circumstances exactly, but his dictatorship has now taken two lives. How many more people need to die? The bodies are piling up.

  5. One is an anomaly, two is a pattern? How could Dave Elsmo be responsible? Since he took power the sailing club and WI Union oversight and day to day operations have seen even greater consolidation in a top down hierarchy. The cultural and organizational shift at Hoofers and the WI Union did occur during Elsmo's time.

    The culture is a new Nanny State where the WI Union and Sailing Club Overlords (sorry, not sure what to call them, but it feels less than transparent) make all the rules, call all the shots and lay down the latest. The previous death two years back reflected many deficiencies in terms of playing it loose. Responsibility and awareness, skipper and crew communication, safety procedures.

    Those around the club know and get it. The UW Lifesaving Boat collision was a tragedy. The death 2 years ago was a travesty destined to recur if no lessons were learned.

  6. What changed since the death of a passenger summer before last? Someone help me here, what new policies address a) Lack of Skipper Control over crew? b) Intoxicants c) Questionable seamanship? A good skipper commands the crew and passengers. A good skipper is capable and able to control the boat. A good skipper needs to make decisions and return to the pier and drop-off intoxicated passengers or end the outing right then and there.

    Are the current Instructors still getting their ratings on upper fleets with a nod and a handshake? If so, that falls on Head of Instruction. Unless this club cleans up its act, it will not be around much longer. I question if that can happen given, as stated in one of the previous comments, that the club has moved from members policing themselves (reporting bad sailors/dangerous activity) to a top-down hierarchy where the members can no longer put a hard-stop on unsafe behaviors/lack of skill.

  7. Drop off intoxicated passengers?! More like ask them if they brought something to share! Alcohol really has little to do with seamanship, you don't forget everything you know just because you had a couple beers. If you are incompetent drunk, you are probably incompetent sober too. The real problem is, favorite sons (and daughters) ARE still getting ratings under the table, and that's on the head of instruction.

    If people want to get rid of Dave, the convince the BOC not to rehire him, or to fire him. Is this not still possible? Fleet Commandeer, can you please enlighten us? Of course, Dave does not personally sign off on every rating. I am not a Daveite but he is probably no worse than most his predecessors.

  9. The Hoofer Club website does not even mention that this tragic event occurred. There should be some official statement rather than leaving club members in the dark. Something like, 'A tragedy occurred and Yu Chen who was an Instructor perished. Although the accident is currently under investigation and details are forthcoming we offer our deepest condolences to his family.'

  10. The BOC has scheduled a meeting to discuss forming a committee to study whether or not the benefits of saying something about Yu on the website would outweigh the drawbacks. The money-handlers are afraid summer membership might take a hit if they advertise that another club member just died while sailing here.

  11. Dear Sirs, you have gone from being a fake news town tattler site to being the only source where Sailing Club Members can find-out what is actually happening at the Club. I found the article in the June 14th update to be most informative. Thank you!

    If you can craft your blog posts into more factual and constructive criticism that would greatly benefit the Hoofer's Sailing Club community at large. This site provides a place where real discussions can and do occur. It is better than the current blackout over the club where any semblance of transparency has been redacted with the darkest of ink.

    Thank you for posting factual information with regards to Hoofer's most recent sailing-related deaths. Also, for posting the Police Reports for the drowning of a passenger on a Hoofer boat. Only by knowing the facts can we as a club learn how to address shortcomings in our day-to-day operations, training and Club Management.

  12. Heave-to and COB was questionable in the previous Hoofer Boat death, were spot checks ever put into place to test rated J-boat and on up members? (crickets chirp...fade to black)

    Simple. One of Dave's High Performance Motorboats speeds out to a craft, board and ask that COB and Heave-to be demonstrated immediately. Can the rated member successfully perform a COB and Heave-To? If not, then the rating needs to be pulled and vessel sent back to pier. Take a remedial lesson and get rating back.

    Heave-to and COB techniques vary from boat to boat. It is incumbent on the Club to ensure that if someone is rated on a boat they should be able to demonstrate competent and able seamanship.

    One more incident and the Club will just get shut down. Finito. Dave and his Flying 420's will move on and prosper elsewhere. The Club may not take human life seriously but the authorities will shut the Club down and replace it with giant swan paddle boats. It is up to the Club Members to figure this one out, agree and implement better measures.

  13. I was surprised that Pirates Day wasnot cancelled after the recent tragedy. It seems people were able to get drunk and act like 12 year olds because they did not know about it. The high winds that prevented sailing in the afternoon almost seemed like divine intervention.

  15. I am disgusted by the sycophants who, essentially, don't want to hear ANY criticism of Harvey. Huh? What the hell kind of attitude is that?

    Yu Chen was sailing at the time of the collision. His sail was UP! I spoke to Chris Kleppe and he said so clearly and directly to me. The family states that Yu Chen was hit from behind. My guess is that this is clearly known because of the damage to his body. His arm was chopped off and his head was also, almost chopped off. The UW Lifesaving boat did this. So if you want me to not criticize UW Lifesaving, then eff off. Because there is no way in hell this is anything other than carelessness. My instincts tell me they were going too fast and not paying attention. People should be going to jail for this. It is that simple.

    If you think that is nuts, or that I am being unfair to UW Lifesaving for years of service, you are insane. Feel free to sweep this under YOUR rug, but there are many of Yu's friends who will fight to ensure he gets justice.

  17. IF the Club Members CARE about helping Yu Chen's family get the truth, it will take public pressure.

    This Commodore's Cup should be held but participants wear T-shirts with Yu Chen's picture and the words 'What Happened?' Maybe paint some sails with 'We want the truth' for Sardine and All Fleets Races. Invite the TV Stations down to cover this silent protest. The media has the ability to pressure public officials to get the official accident report published.

    We have to take a stand and support Yu Chen's family! Let's show WI Union and Club Leadership that this is our club and we look after each other. Let the truth come forth.

  19. Just to play devil's advocate here, there is one scenario where the accident could have conceivably have been partly or entirely Yu Chen's fault. Let's say he decided to buzz the motorboat and shout hello, and something went wrong. Maybe they suddenly slowed and he had to pass in front of them instead of astern. Maybe there was a big puff at just the wrong moment, or maybe the wind dropped suddenly as he entered their wind shadow. All of this could have happened in a few seconds.

    The wind at the time was WNW 12 mph gusting 20. That means there would have been some waves over on the east part of the lake, which could also have contributed. It also means an experienced windsurfer could go fast.

    Yes it is 100% speculation, and knowing Yu, seems unlikely. But we just don't know all the details yet. This does not address the officials refusal to release information.

    I hope this post doesn't give them any ideas for doctoring their report. :-(

  20. How could two very skilled operators run into each other? The wind data for that day gives a clue.
    Weather for that day shows WSW wind direction, moderate median wind (8-12 kt) but with pretty severe > 20 kt puffs (blue square dots above the red windspeed line) which would likely have been even stronger near the windward shore. The windsurfer could have been approaching the south bearing motorboat from astern on a starboard beam reach, not seeing the motorboat beneath his sail. If he was hit by a strong puff as he was overtaking the motorboat he would have borne away sharply, possibly right in front of the motorboat.

  24. @Open_blog_group: The link you posted is for May TWENTY first, not May 31. Mistake or deliberate misdirection..? Sorry, but there is a lot of misinformation flying around these days. What I posted above is correct - it was WNW at 12-20, not WSW. Your hypothetical scenario is still possible with slightly diff angles, but as someone else noted, we are just blowing snot into the bilge until the official report comes out.

    The wundergound link above can be used, just cut and paste it but edit "21" to "31" before hitting Enter. Note that the wind was steady WNW all day long, so some waves would have built up.

  25. Sorry for typing the wrong date. The wind at 5 pm on Wednesday, May 31st was 8-12 kt out of the WSW with 18 to 25 kt puffs. The Weather Underground doesn't appear to show the the direction of puffs but they tend to be more perpendicular to shorelines, i.e. more southerly, And all puffs are knocks which would have steered a faster weather boat (windsurfer) toward a slower leeward boat. And, unlike on a ballasted boat, windsurfers are more inclined to bear away sharply to accelerate than to ease.

    btw, what is it about the grumpy old men in hoofers that they feel compelled to 'anonymously' make snide remarks and insult everyone in the universe? It used to be due to an overdrinking culture.

  27. The silence from the Club Leadership and WI Union says a lot about how they view the Club Members. Just terrible that Yu Chen's family has to pay for an attorney to find out what happened. The early inaccurate reporting made it sound like Yu Chen just slammed into UW-Lifesaving boat. Not our fault, his bad. What? Facts just revealed that wasn't the case? They ran him over from behind causing his arm to get chopped off along with who knows what.

    I think having a silent protest during Commodore's Cup is a good idea. T-Shirts with Yu Chen's photo and a candlelight procession around the Terrace. Let that sink in.

  28. Whether we like it or not, the 'silence' is standard protocol while a government agency is investigating the accident. We have no 'facts', only suppositions. And they have no control over speculations by media and people like you: "Not our fault, his bad..."

    Is sensationalizing the incident with speculation of any value? Is his family doing that? Are his friends doing that?

    If a car passes you and then swerves into your lane and slams on the brakes, are you at fault for hitting him? The courts rely on specific laws that govern responsibilities during lane changes. In this case, they probably align with our intuition that the passer who changed lanes without 'adequate' warning was at fault.

    If a windsurfer passes a motorboat and swerves in front of him without warning, would we apply similar reasoning about not giving warning? Or would the responsibility of the moving motorboat to keep clear prevail? That is, should a motorboat quickly come to a stop or steer well clear immediately when a sailing craft comes close regardless of his approach?

    This is a question we could discuss without speculating about what actually happened or who was at fault.

  32. Oh, you beautiful fools! Firing Dave Elsmo won't fix anything, even if the irrelevant BOC still had the authority, which they don't. He knows which way the wind is blowing and trims his sails with finesse to fulfill his ambitions, but he doesn't make the weather. The fact is that the so-called club hasn't been run by its members since, oh, 2002 or so. Y'all just didn't notice the change until they started to fuck with the alcohol and dammed up the free flowing streams of beer. It's now the Wisconsin Union sailing program, operated by OutdoorUW. Get rid of Elsmo, and they'll just hire another sailing program manager to replace him. The professional administrators have taken over control of the universities, and even the professors now find that they're shut out policymaking at their own institutions. Student control is never coming back. It's the way the wind is blowing.

  34. "Take it up with the police"? That's like asking coyotes to investigate foxes in the henhouse. Cops are corrupt. This article shows that the entire Chicago Police Department (up to superintendent) is corrupt, and hundreds of other articles and court cases demonstrate police corruption nationwide, including Madison and Milwaukee.

    Didn't you ever see the movie "Cop Land"?

    Most cops are... cops. Just people. But with training, and the desire to serve the public. Like firefighters, and teachers, and lots of other people. Do I think some cops are idiots? Sure. Do I think some are corrupt? Sure, and probably in the same radio as in any other line of work. But mostly I think they're sincere and ethical.

    If you're the person who made the original post, then how about this: If you have actual information backing up the claim that the lifesaving boat is back in service "presumably so active use will wash off whatever evidence remains," then post that evidence here, and we can all help get it all out in the open. If you have zero knowledge of any such thing, then your readers and I will know to write you off as a... what? Person who's overly cynical and feels free to slander? I guess that's the norm these days.

And if you call the sheriff's office after they close at 4 pm, you get a recorded message saying "We are busy assisting other customers, please hold and your call will be answered in the order received." But, they've already left for the day! Doesn't inspire much confidence.

After 2.5 months, A spokesperson for the Dane County Sheriff’s Office told News 3 the department recently received blood test results from the boat's driver and turned its findings, including a review from the medical examiner, over to the Dane County District Attorney’s Office.

WI Union can develop the premium shoreline into the Alumni zone. Plus more parking for motorboats coming to the Union for Ice Cream and pics in the big chair.

  48. Overheard the above as well. This is the last season for sailing club. Once hoofer volunteers have boats secured and piers-out for winter the announcement will follow. Like a thief in the night it will all be gone.

  50. Get real, Hoofer sailing club isn't going anywhere. Why are we coming up with a budget for next year if there is no next year? Why are we getting new boats and donations if HSC is going away?

    That said, there are many dishonest people who work at the Wisconsin Union, and I wouldn't be surprised if Director Guthier hatched a plan years ago to get rid of HSC and replace it with a big ice cream stand. But it is hard to believe they would do that after just doing a major renovation a few years ago.

    Hmm, although the new Hoofer layout does seem more suited to institutional food service than student clubs, with the Mendota lounge as a fancy restaurant, the big office for overflow and rental parties, food service access is already right there,.... yikes.

  51. They don't ask, they just do it. After renovations, Hoofers is just an eyesore that does not fit the family friendly environment. It's a business! Insurance, staffing a UW Rescue station and not to mention some really prime lakefront property. No, Hoofers is about to expire. The Sailing Team is moving along with 420's to the Porter Boathouse area. All the collegiate water sports in one spot.

    I have worked for many businesses that continued to stock-up, invest in infrastructure when they knew fully well that it would be absorbed and dismantled within a year by another company. That's just how it is. Proud to have been a Hoofer.

  54. All of June. All of July. All of August. Now mid-September. That's almost an entire sailing season at Hoofer's without any kind of root cause analysis of Yu Chen's death. And, his family must have known something was not right when they had to hire an attorney after the authorities clammed-up. I'm just shaking my head. This reeks.

Anyway, the report will supposedly be available in September, and I'm going to request it. If and when such I actually receive a copy, I'll share it here, or somewhere.

  57. Agree that is hardly CSI: Miami. More like CSI: Hoofers where there is no attempt to alert the club or public that a key piece of evidence (arm with GPS watch) is bumping around in the lake. At best, they are just incompetent when handling matters like these. Nothing more, nothing less.

  59. I believe that the Pythagorean Theorem is used to calculate. 119 days to remember how to use the theorem (lot of time and space since the SAT/ACT) and 1 day to conduct investigation.
